According to the Family and Medical Leave Act, an employee must have performed more than 1,250 hours of service during the previous 12-month period in order to be eligible for its benefits. While the Act does require that the employee have worked for the employer for at least 12 months, this need not be consecutive or with a single employer. Maternity leave is one of the eligible reasons for taking leave, but claiming it in the past does not disqualify an employee from using FMLA.
