Joe Ortiz was discharged from Magma Copper Co. for absenteeism. He missed the last shift of work before he was fired because he was temporarily in custody following an arrest for a criminal offense. He filed for unemployment but was denied. Mr. Ortiz said he notified Magma that he was missing because of being detained in jail. The unemployment compensation agency says Mr. Ortiz is disqualified for benefits because he was fired for misconduct. Who is right?
