On May 2, Mavrick orally contracted with the Target Appliance Center to buy for $475 a TV for his new apartment. Mavrick and the Target salesperson both agreed that delivery would be made on July 2. On May 10, Mavrick phoned Target and requested that the delivery date be moved to June 2. The Target salesperson agreed with this request. On June 2, Target failed to deliver the TV to Mavrick's apartment because of a shortage in the warehouse. The Target salesperson then informed Mavrick that it would now deliver the TV on July 2 as originally agreed. Mavrick insists that Target has breached its contract with him. Target contends that its agreement to deliver on June 2 was not binding. Is Target's contention correct?
