Scampoli, a merchant, sold and delivered a new TV set to Wilson. When Wilson discovered that the set did not work properly, he asked Scampoli to correct the problem. Scampoli's repairperson, however, could not fix the set at Wilson's house and stated that the TV set would have to be taken back to the store and dismantled to determine the cause of the problem. Wilson refused to let the set go; instead, he demanded that Scampoli deliver a new TV or else refund his money. Scampoli said no to the refund and insisted that he be given the opportunity to correct the problem with the TV before returning the purchase price.
