An administrative agency is a federal, state or local government agency that is established to perform functions. They are also known as rule-making bodies whose main purpose is to make rules. These rules affect businesses operation, financing, capital structure, recruitment and selection procedure and so on.
While making or enacting any new rule, it is mandatory for agencies to make a rule that are legally binding on all business. APA (Administrative Procedure Act) imposes a strict policy over agencies. APA states that each agency must follow a strict procedural requirement while making legislative rules or other functions. According to this rule, an agency must follow the following procedure before making final rules:
Step 1: Agencies should publish the proposed rulemaking proceedings in the public notice.
Step 2: Agencies should allow and encourage public to express their ideas and comments on the proposed rules
Step 3: Agencies should view and consider these ideas or comment before making final rules.
Rules are enacted only when it is binding to all the business and are taken with due consideration of people who can be affected by it.
Therefore, in the given case A O corporation have the right to raise its voice against the rules and can state the negative impact the rule on its's business.
