Albright was hired to be a bodyguard for Madonna. He became romantically involved with her for two years. Several years later he contracted to sell information about Madonna for a biography. One chapter featured his relationship with her. The book had 48 pages of photos, one of which showed Madonna accompanied by two men. One of the men was identified as Albright and the caption said that he was her secret lover and one-time bodyguard. In fact, the photo was of Jose Guiterez. People magazine and News of the World reprinted the photo and caption. Albright sued for defamation because Guiterez was an "outspoken homosexual" who "often dressed as a woman" and engages in allegedly "homosexually graphic, lewd, lascivious, offensive and possibly illegal conduct." Will he be successful? Explain why.
