Giovo was in an accident with McDonald. McDonald's insurer, GEICO, and Giovo's attorney exchanged offers and counteroffers to settle Giovo's negligence claim. GEICO eventually agreed to meet all of Giovo's settlement conditions except her demand to be paid $18/day for the loss of the use of her car. As to that point, GEICO proposed to pay $10/day. Giovo rejected this and filed an action against McDonald. McDonald contended the matter had been settled. Is this correct? Explain.
