Carnese was suffering from the effects of a stroke. She had an idea for an estate plan that included residuary bequests to two relatives. An attorney met with her and promised to prepare her will that would be invulnerable to being contested in order to maximize gifts to the residual beneficiaries. She died a few weeks after she signed the will. Soon thereafter, the will was challenged. Settlement of the contest resulted in a depletion of $620,000 from the residual estate. The residual beneficiaries sued, claiming they were donee beneficiaries of the lawyer's promise to prepare a will that wouldn't be subject to challenge. Are they intended donee beneficiaries? Why?
