About six weeks after Clark was diagnosed as pregnant, her doctor, Norris, determined the fetus was dead and that a minor surgical procedure, a D C (dilatation and curettage), was necessary to remove it. During the D C, Norris perforated Clark's uterine wall and damaged her intestine. As a result, she required additional surgery and suffers from chronic diarrhea. Clark was not allowed to use res ipsa loquitur to help prove her malpractice case against Norris, and when she lost, she appealed. Should res ipsa loquitur apply to this case?
