Wyers, a 59-year-old recently widowed woman with no income, met Gilreath, a 29- year-old who told her he loved her and offered to marry her. He also offered to help her with her finances. He took Wyers, who had a limited ability to read and write and who was taking several medications that impaired her reasoning ability, to a lawyer's office to sign some papers. She thought she was signing for a loan; she actually conveyed her home to Gilreath. He then tried to get a loan on the house from United Companies Financial Corp. United became suspicious after doing a title search and required Gilreath to bring Wyers in to sign the mortgage. After Wyers signed, a check for $13,775 was made out to her, but it was given to him. He cashed it and disappeared. Can Wyers set aside the transaction on the basis of undue influence?
