King Leopold III of Belgium was forced to abdicate the throne in 1950, and he lived in exile in Switzerland. Time passes slowly for exiled monarchs, and Leopold turned to the simple pleasures of life, such as cars capable of speeds of 200 mph. One of these was his 1954 custom-designed 375 Pinin Farina Cabriolet, known as the "King Leopold Ferrari." When he tired of the car, he sold it, and it eventually fell into deplorable mechanical condition. In 1969 Golomb bought the car and shipped it to Illinois where he, his family, and his girlfriend, Voyles, spent more than a decade restoring it. Lee, an exotic car fancier, saw a picture of the car in 1985 and asked how much it would take to buy it. When told $275,000, Lee countered with $175,000, which was refused. Lee made several other, higher offers, all of which were rejected. He finally offered $275,000. Lee claims Golomb accepted. Golomb, however, claims he said he would have to check with his family but had Lee make out four checks, one to him, one to Voyles, and two to family members, which Lee did. Voyles endorsed her check. The family decided they could not bear to part with the car, and Golumb returned the checks to Lee. Lee sued to have the court order specific performance of the alleged contract to sell the car. Was Voyles's signature on the check, along with written offers, sufficient for a "signed writing"?
