Tan It All operated a tanning salon, Tansyou, in Suite C-5 of the shopping center. At the time of the theft, the truck was parked 280 feet from the front entrance of the salon. Tan It All was insured by Evergreen, and its policy provided coverage for "business personal property located... within 100 feet of the described premises." The premises were described as "13945 North Highway 183, Suite C-5, Austin, Texas 78717." Tan It All submitted a claim for the value of the equipment to its insurance company. The claim was denied because the "property was not within the coverage area at the time of the theft." Tan It All sued the insurance company for breach of contract. Can the insurance company exclude coverage for the theft? Why or why not?
