The Nuclear Regulatory Commission (NRC) was responsible for the decision to allow the once-crippled Three Mile Island Unit I nuclear plant to resume operation. Pursuant to the NEPA, the NRC considered the impact on the surrounding community and determined that there would be no adverse impact. A group, People Against Nuclear Energy (PANE), intervened in the action by the NRC and asked that the court require the NRC to consider whether the risk of a nuclear accident (as had been experienced with the original shutdown of the plant) might harm the community in a psychological sense. The NRC says the risk of an accident is not an effect on the environment. Is psychological health a factor in EIS evaluations?
