The La Gasse Company contracted with the City of Fort Lauderdale to renovate one of the city's swimming pools. When the job was nearly complete, vandals severely damaged the pool and most of the work had to be redone. La Gasse sought additional compensation, which the city refused. La Gasse sued, claiming that the subject matter of the contract had been destroyed, thus discharging it from responsibility.
