In May 1976, TRW (a credit reporting agency)issued a consumer report on Bennie E. Bryant in connection with his application for a federally insured home loan under the Veterans Administration. The consumer report had several inaccuracies, and Mr. Bryant went to TRW to point out the matters needing correction. For unrelated reasons, the mortgage did not close.
In August 1976, Mr. Bryant applied for another mortgage. On September 28, TRW called the mortgage company to let them know his credit report would be unfavorable. When the mortgage company notified Mr. Bryant, he again went to TRW offices and explained that the September report contained new inaccuracies in addition to those that were part of the May report. After this meeting, a memo about possible inaccuracies was placed in Mr. Bryant's file. However, the credit report without corrections was issued to the mortgage company on September 30. No follow-through had been done on the file memo.
Mr. Bryant's August mortgage application was originally denied. After personal efforts on his part, however, the credit report was corrected and the mortgage was eventually given.
