Contract Packers rented a truck from Hertz Truck Leasing. The brakes of the truck did not function properly. This resulted in injuring Packers' employee Cintrone while he was riding in the truck as it was driven by his helper. Cintrone sued Hertz for breach of the implied warranty that the truck was fit for normal use on public highways.
