On April 19, 1995, a bomb made with ammonium nitrate fertilizer destroyed the Alfred P. Murrah Federal Building in Oklahoma City. People injured in the bombing filed suit against the manufacturers of ammonium nitrate alleging liability under a variety of theories including negligence per se. They alleged the defendants violated laws and regulations regarding the sale of explosives. "Explosives" is defined as "any chemical compound, mixture, or device, of which the primary purpose is to function by explosion, and includes but is not limited to dynamite and other high explosives.... " Does the doctrine of negligence per se apply in this case?
