Crookham Vessels was the general contractor on a project to build an extension of a railroad for the Little Rock Port Authority. Larry Moyer Trucking (Moyer) was subcontracted to do the excavation and dirt work for the project. Moyer dug several ditches as part of its work, but they kept collapsing due to drainage problems. After redigging the ditches several times, Moyer refused to continue work unless he received extra pay for again redigging the ditches. Crookham Vessels agreed to do this but later refused to pay. Was there consideration for Crookham Vessels' promise to pay more to have the ditches redug?
