Earl Webster was a 39-year-old construction worker in good health. While shoveling sand into a wheelbarrow on a Texas road crew in 97-degree heat, he complained to fellow workers that he was sick. He stopped to have a drink of water, pushed two more wheelbarrows, lost consciousness, and was taken unconscious in the car to the company offices. He died a short time later of heat prostration. Is his spouse entitled to death benefits under workers' compensation? Would it make a difference if the water given to him to drink was bad?
