When a lawsuit brought into a trial court or a higher court , the court must decide if the reason to sue by plaintiff is legal or not, or if the defendant is liable. When a court ruled that plaintiff has a legal reason to sue and defendant is liable , the court may proceed to resolution. The liability decided by precedent or case laws can be used by judges to make decision.
A precedent or case laws can be defined as decisions made by judges in various courts that later became rule of law and applied to future cases. However, precedents are not enacted by law, but judges refer precedents while giving judgements for other court cases.
