In New South Wales a Union May Conduct a Prosecution

In New South Wales a union may conduct a prosecution for a serious breach of Workplace Health and Safety laws if:

A) the breach involves a Category 1 or Category 2 offence.
B) NSW WorkCover decides not to prosecute the breach.
C) the NSW Director of Public Prosecutions recommends that the prosecution takes place.
D) all of the above are satisfied.
E) A and B only are satisfied
