Title VII prohibits discrimination in employment including in the area of compensation, but even before Title VII there was legislation protecting employees against discrimination in compensation solely on the basis of gender. The year before Title VII was passed, the Equal Pay Act (EPA), actually part of the Fair Labor Standards Act (FLSA) governing wages and hours in the workplace, became law. Under the act, employers subject to the minimum wage provisions of the FLSA may not use gender as a basis for paying lower wages to an employee for equal work "on jobs the performance of which requires equal skill, effort, and responsibility, and which are performed under similar working conditions."
