For enterprise coverage, all employees of a business will be covered if the business is engaged in interstate commerce or in producing goods for interstate commerce and meets a minimum gross annual income requirement of $500,000. The law applies to both part-time and full-time employees. Federal, state, and local employees are also covered by the law, though there are some specific provisions for certain state and local employees. If an employee works for certain types of businesses, the $500,000 minimum does not apply. That is, employees will be covered even if their employer does not make at least $500,000 per year. These organizations include hospitals and other institutions primarily engaged in the care of the sick, aged, mentally ill, or disabled who reside on the premises; schools for children who are mentally or physically disabled or gifted; preschools, elementary, and secondary schools and institutions of higher education; and federal, state, and local government agencies. The law also covers domestic service workers such as day workers, housekeepers, chauffeurs, cooks, valets, or full-time babysitters (defined as other than those babysitting on a casual basis; typically requiring at least 20 hours per week). State laws also may apply, and when both cover a situation, the law setting the higher standards must be the one used.
