The Patient Self-Determination Act was enacted in 1991, requiring healthcare facilities that are certified by Medicare and Medicaid to notify adults who enter their facility of their right to refuse or receive medical care and their right to have an advance directive. The decisions can be revoked at any time while the patient is cognitively intact and has decision-making capacity. It is not relevant if the physician accepts the documents or not. Giving the client papers to fill out is only part of the process; clients and their families must be educated on what the directives mean, assisted to consider their choices, and fill out paperwork. The education comes first. The nurse would call someone from Social Services (or another appropriate department) to assist the client.
