Double Jeopardy does not apply when a conviction is reversed on appeal, except in circumstances where the reversal was due to insufficient evidence. In such cases, the defendant cannot be retried for the same offense. In all other cases, the prosecution can re-file the charges and bring the defendant to trial again. However, the prosecution cannot present the same evidence that was used in the original trial, and must have new or additional evidence to support the charges.
