You should send a letter to the collector demanding that they provide verification of the debt as required by law. In the same letter, you should also inform them that they are in violation of the FDCPA and demand that all communications regarding the debt cease. If they continue to threaten court action, you can report them to the Consumer Financial Protection Bureau (CFPB) and/or consult with an attorney. Simply paying the debt without verification may not be in your best interest if the debt is not valid or if there are errors in the amount owed. Renegotiating payment terms may also not be the best option if you are uncertain about the validity of the debt. Similarly, paying half the outstanding balance without first verifying the debt may not be in your best interest. Sueing the collection agency should also not be your first option.
