The Durham Test Judges a Person Not to Be Criminally

The Durham test judges a person not to be criminally responsible if he or she has:

A) acted under the influence of a mental disease or mental defect.
B) acted under a compulsion or an irresistible impulse to act.
C) acted without the knowledge that the nature of the act or actions were wrong.
D) lacked the ability to conform his or her conduct to the requirements of law, as a result of mental disease or defect.
