In the Supreme Court case Brown v. the Board of Education, the decision to desegregate schools was based upon the Bill of Rights. Brown v. the Board of Education of Topeka Kansas, a 1954 Supreme Court Case, brought school discrimination to the Supreme Court. A young student, Linda Brown, had been denied admission to her local elementary school for being black. Thurgood Marshall, an NAACP lawyer who would eventually become the first black Supreme Court Justice, successfully argued the case. The Chief Justice of the time, Earl Warren, overruled the 1896 Plessy v. Ferguson case and decided that the concept of "separate but equal" does not belong in the public school system.
